Property Diminution

The presence of environmentally degrading operations and conditions – such as hazardous waste sites, landfills, industrial and commercial facilities, groundwater contamination, odor, and noise – may result in real property value losses. IEc provides expert analysis of changes in property values resulting from such degradation in both individual and class actions.

Environmental Litigation

Changes in environmental quality, whether it be the presence of a plume of contaminated groundwater, a nearby hazardous waste site, an oil spill or hazardous air emissions may result in economic damage to private parties. IEc applies economic and financial damage models to assess these losses. For example, we provide expert analysis of changes in real property values resulting from environmental degradation in both individual and class actions.

Breach of Contract

Breaches of contract can precipitate claims of economic damage claims. IEc provides expert economic and financial expertise to support the adjudication of such claims. We have particular skill in evaluating or determining alleged expectancy damages, such as lost profits and additional costs incurred by the plaintiff as a result of a breach. In this context, we assess the critical criteria in developing or defending expectancy claims, including linking the breach to the causation of damages; identifying whether damages were reasonably foreseeable at the time of the contract formation; and determining whether damages can be computed with reasonable certainty. We also measure reliance damages, or costs associated with the contract that the plaintiff would never had incurred “but for” the contract, and restitution damages, or recovery of any benefit conferred by the plaintiff on the defendant as a result of the contract.
